US EPA issued this Notice of Warning to Innolytics, LLC (Respondent), of Ranch Mirage, California, under the Federal Insecticide, Fungicide and Rodenticide Act. Under FIFRA Section 12(a)(l)B, it is a federal violation for a distributor of a pesticide to make claims that differ from the registration under FIFRA Section 3. Respondent's communication in person and by written response to Nevada Community Management and its agents demonstrated a purposeful deviation from the Directions for Use associated with registration of OvoControl P. Respondent is hereby advised to take all the necessary actions to assure that any further production, distribution, and/or consultation of pesticides is made in full compliance with the provisions of FIFRA, including any advertising or marketing materials. Making claims that differ from the registration is a prohibited act under FIFRA 12(a)(l)(B) and can result in civil penalties of up to $19,936 per violation.
