.On September 23rd, 2019, EPA Region 6 filed Consent Agreement and Final Order under its authority pursuant to Section 3008(a) of the Resource Conservation and Recovery Act (?RCRA?), 42 U.S.C. ? 6928, as amended by the Hazardous and Solid Waste Amendments of 1984 (?HSWA?), and is simultaneously commenced and concluded through the issuance of this ACOC under 40 C.F.R. ?? 22.13(b) and 22.18(b)(2) and (3) to Gulf copper and Manufacturing Corporation located in 2020 S Gulfway Dr , Port Arthur, Texas 77641. The CAFO was issued in response to violations of: 1. Failure to accurately notify hazardous waste generation, and 2.Failure to file Biennial Reort 3. Failure to comply with Large Quantity Generator (LQG)requirements 4. Failure to meet the LDR requirements. The CAFO requires Gulf Copper to 1. Certify that all solid waste streams have been assessed to determine the accurate waste codes and has developed and implemented Standard Operating Procedures (?SOP?) to ensure that its operating in compliance with RCRA and regulation requirements; 2. Certify they has accurately and adequately complied with RCRA Section 3010 Notification; and 3. Provide a copy of the SOPs along with its certification. Omega Protein Inc must respond to EPA Region 6 within thirty (30) calendar days of the effective date of the settlement agreement.
