Summary

The Regional Judicial Officer issued a Final Order on September 21, 2021, accepting the Consent Agreement to commence and settle violations of CERCLA Section 103 and EPCRA Section 304. EPA determined that Sea Watch International, Ltd., the owner and operator of a seafood processing facility in Easton, Maryland, failed to timely report the release of 337 pounds of anhydrous ammonia from the Facility on September 28, 2019 to the National Response Center, in violation of CERCLA Section 103, and to the State Emergency Response Commission, in violation of EPCRA Section 304. In settlement, Sea Watch International Ltd. has agreed to pay a cash penalty of $23,669, consisting of $11,835 for the CERCLA violation, and $11,834 for the EPCRA violation. Maryland has not received delegation of the CERCLA and EPCRA emergency notification program but has been notified of this enforcement action.
