After being unable to come to an agreement with the Respondent, the ENF Team filed a Complaint to resolve this matter. The Complaint proposes a penalty up to the administrative statutory maximum of $313,448 be assessed against Respondent for failure to close on large capacity cesspool. Respondent has 30 days to contest allegations. If Respondent fails to submit a formal response within 30-days, then Respondent may be determined to have defaulted. If a default order is entered, the entire proposed penalty may be assessed without further proceedings.
