On September 13, 2022, EPA Region 1 entered into an Expedited Settlement Agreement with Justin Parker d/b/a 21 Motorsports, (21 Motorsports), an online retailer based in Clinton, Massachusetts (at the time of violation), resolving violations of Section 203(a)(3)(B) of the Clean Air Act (CAA) through 21 Motorsports?s online sales of aftermarket emissions tampering devices. The administrative penalty case alleged that 21 Motorsports sold 11 illegal motor vehicle parts. Under the settlement, which is authorized under the Expedited Settlement Agreement Pilot for Clean Air Act Vehicle and Engine Violations Tampering/Defeat Devices, 21 Motorsports will pay a penalty of $5,697 and certify it is operating in compliance with Section 203 of the CAA. EPA, through its direct implementation authority, plays a critical role in addressing tampering and aftermarket defeat device pollutant sources. EPA has notified the Massachusetts Department of Environmental Protection of this matter. While this case may benefit EJ areas because it affects mobile sources, it is not possible to identify specific EJ impacts due to the nation-wide distribution of the sales.
