On September 15, 2022, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to Section 313 of EPCRA to Frito-Lay Inc. located in Irving, TX. The CAFO was issued in response to an alleged violation of 42 U.S.C. Section 11023(a) and 40 C.F.R. Part 372.30(d) by failing to submit a reporting form for nitric acid for the 2021 calendar year on or before July 1, 2022.
By signing the CAFO, Frito-Lay certifies that it has corrected the violation and will pay a civil penalty of $8,488.
