On September 14, 2022, EPA filed a Consent Agreement and Final Order (CAFO) resolving alleged violations by Weaver's Cove Industrial Park, LLC (WCIP) of its Clean Water Act National Pollutant Discharge Elimination System (NPDES) Permit (Permit) in Fall River, Massachusetts. These violations include failure to sample, late submittal of Discharge Monitoring Reports, failure to maintain an oil/water separator, and failure to conduct inspections. The CAFO requires that WCIP pay a penalty of $47,500 for past permit violations and certify that it has come into and will remain in full compliance with the Clean Water Act and the Permit. The WCIP is located in an area having Environmental Justice concerns. The Massachusetts Department of Environmental Protection is supportive of this action.
