On September 12, 2022, Region 1 settled an administrative penalty action against Excelitas Technologies Corp. (Respondent) resolving an alleged violation of Section 112(r) of the Clean Air Act for failure to conduct a sufficient process hazard review (PHR) for its electrical component manufacturing facility located in Salem, Massachusetts (Facility). Respondent uses anhydrous ammonia, pressurized hydrogen gas, hydrofluoric acid, nitric acid, and cyanides in its operations. The consent agreement and final order requires Respondent to pay a civil penalty of $46,968. CAA 112(r) is a direct implementation program, but EPA has notified the Commonwealth of Massachusetts of the settlement. The Facility is not in a national environmental justice area of concern, but the census block encompassing the Facility exceeds the 90th percentile for the state and EPA Regional measures for 10 of the 12 environmental justice indices.
