SEPTEMBER 12, 2022 - NOTICE OF REFUSAL OF ADMISSION
FIFRA 12(a)(1)(F): To sell or distribute a pesticide device that is misbranded. Specifically, the device's labeling appears non-compliant with the following requirements: Device labels must include adequate directions for use and a warning or caution statement. The product label does not appear to reference or include directions for use as part of the label or labeling or have precautionary language provided on the label,
pursuant to FIFRA 2(q)(1)(G) and (F), respectively. The product label does not contain on the label the name and address of the producer,
registrant or person for whom the product was produced pursuant to 40 CFR 156.10(a)(ii) and (c).
The product label appears to include claims that are false or misleading in relation to the efficacy and safety of the product, which are prohibited under FIFRA 2(q)(1)(A) and 40 C.F.R. 156.10(a)(5). Such claims include most eco-friendly, safest, and the use of the
terms sterilize and disinfection? without qualifying information to support the use of these terms.
