The importer, Ant Moving Trading Inc., attempted to import a shipment of the misbranded pesticide devices, ( ?Turonic Air Purifier PH950?) into the United States. FIFRA defines a device as ?an instrument or contrivance (other than a firearm) that is used to destroy, repel, trap or mitigate (lessen the severity of) any pest such as insects, weeds, rodents, certain other animals, birds, mold/mildew, bacteria and viruses.? The distribution of a misbranded pesticide device is an unlawful act under FIFRA Section 12(a)(1)(F), 7 U.S.C. Section 136j(a)(1)(F).
