On June 29, 2023, EPA settled an enforcement action against Artisan Chef Manufacturing, LLC (Artisan) for alleged violations of Section 312 of the Emergency Planning and Community Right-to-Know Act (EPCRA). Artisan allegedly violated EPCRA Section 312 and its implementing regulations by failing to timely submit its Tier II chemical inventory reports for anhydrous ammonia for calendar years 2020 and 2021. Artisan operates a specialty food production facility in Lawrence, Massachusetts in an area of potential environmental justice concerns. Artisan agreed to pay a settlement penalty of $63,837. The EPCRA Tier II reporting program is a non-delegated federal program enforced only by EPA. Enforcement of EPCRA's Tier II reporting requirements ensures that first responders and emergency planners have information regarding potentially hazardous chemicals present at local facilities.
