Summary

On July 16, 2024, Region 10 filed an expedited settlement agreement resolving CWA violations of the state of Oregon's 1200-Z Industrial Stormwater Discharge Permit by the Port of Toledo at its boatyard in Toledo, Oregon. Alleged violations included failure to minimize exposure, missed monthly routine site inspections and discharge visual assessments, and missed annual employee training as required by the permit. This enforcement action stands to prevent an annual discharge of 66 pounds of Biological Oxygen Demand, 734 pounds of Chemical Oxygen Demand, 9 pounds of Nitrate + Nitrite Nitrogen, 23 pounds of Total Nitrogen, 9 pounds of Total Phosphorus, and 472 pounds of Total Suspended Solids into the Yaquina River. The Respondent agreed to pay a penalty of $1,648 and has returned to compliance.
