On August 6, 2025, EPA Region 3 entered a Consent Agreement and Final Order with KL-ChemPak, Inc. ( Chempak ) that initiated and resolved alleged violations of FIFRA and its implementing regulations related to labeling of bulk pesticide tanks. The violations arise from Chempak's possession and use of pesticide product-containing ISO tanks that lacked the required EPA-accepted labeling within the immediate vicinity of the discharge control valve, as mandated by 40 C.F.R. 156.10(a)(4)(ii)(B). These violations hinder the enforcement of regulatory programs aimed at safeguarding human health and the environment from unreasonable risks posed by pesticides, a primary objective of FIFRA, and this enforcement action is in furtherance of Administrator Zelden's Pillar 1: Clean Air, Land, and Water for Every American. Chempak will pay a penalty of $9,600 within 30 days of the Effective Date. The settlement required Chempak to certify compliance with applicable FIFRA requirements. PDA was provided notice of the planned enforcement action and had no objections.
