This is an Administrative Penalty action with Consent Agreement/Final Order pursuant to RCRA Section 3008 issued to Siemens Water Technologies Corp. successor to Westates Carbon of Arizona, Inc. The violations include: failure to comply with RCRA subpart 262 generator requirement by not closing a container holding hazardous waste; failure to comply with subpart 265 requirement to record deterioration of the secondary containment and the nature of the repairs or remedial action; and failure to comply with secondary containment requirements by not meeting the capacity requirements and failing to maintain the secondary containment free of cracks and gaps. Westates Carbon has agreed to pay a penalty of $27, 059 and maintain sufficient inspection procedures and construct secondary containment for the hazardous waste tanks.
