This is an agreement with a Bona Fide Prospective Purchaser (the University of Portland) that calls fro the University to conduct a removal action up to $3 million in exchange for a covenant not to sue and contribution protection in relation to the Portland Harbor site in the context of the University's anticipated purchase of the properties currently owned by McCormick & Baxter, Inc., and Triangle Park LLC respectively. This purchase will provide benefits to the public and result in utilization of otherwise idle property.
