The facility failed to monitor its pumps and valves as required by 40 C.F.R. Parts 265.1052 (a) & 1057 (a). The facility also failed to conduct annual inspections of its tanks as required by 40 C.F.R. Part 265.1085(c)(4)(ii). This case was handled by the expedited settlement protocol whereby a complaint was not issued because the facility & EPA agreed on a penalty and a CAFO was issued.
