On September 19, 2006, Respondent violated 40 C.F.R. Part 89 by importing into San Juan, Puerto Rico twenty-five generators containing uncertified diesel engines (generator sets). U.S. Customs and Border Protection seized the generator sets. In addition to paying a civil penalty of $36,000, Respondent shall export the generators to a location outside of North America and the territories of the United States.
