Motts failed to submit a Toxic Release Inventory Form A report for ammonia for calendar years 2001 and 2002 and for nitrate compounds for calendar years 2003 and 2004 . The Respondent submitted the Forms A to the EPA on May 2, 2006 and May 26, 2006. This failure to submit Form A reports, in a timely manner, constitute violations of Section 313 of the Emergency Planning and Community Right-to-Know-Act, 42 U.S.C. § 11023, and with 40 C.F.R. § 372.30. This is a combined administrative civil complaint and consent agreement final order action with a penalty of $48,636.
