This is an ability to pay (ATP) agreement in the form of an Administrative Order on Consent (AOC). The agreement is undertaken pursuant to CERCLA 122h and involves a total of twelve potentially responsible parties (PRPs) from the Omega Chemical Superfund site. These are de minimis parties, which contributed anywhere from 3.0 to 9.9 tons of waste to the site. The agreement establishes a total cost recovery payment in the amount of $111,250.
