GEO Specialty Chemicals, Inc.(GEO) facility located at 50 North Market Street, Gibbstown, NJ failed to submit Toxic Release Inventory Form R reports for acetophenone, cumene, cumene hydroperoxide and phenol for calendar year 2004. The Respondent submitted the Forms R to the EPA on July 31, 2006. The failure to submit a Form A or Form R report, in a timely manner, constitutes a violation of Section 313 of EPCRA, 42 U.S.C. §11023, and 40 C.F.R §372.30.
During settlement negotiations, the company agreed to undertake a Supplemental Environmental Project (SEP). The company has agreed to purchase Emergency Response Equipment in the amount of $40,665 for the local police department as a SEP in the settlement. The SEP involves the purchase of Mobile Data Terminals units for seven first-responder vehicles.
This is a combined administrative civil complaint and consent agreement final order action with a penalty of $10,830, plus the above referenced SEP.
