The settlement addresses Clean Air Act (CAA) violations at CountryMarkÂs petroleum refinery located in Mount Vernon, Posey County, Indiana. This settlement will be the 32nd settlement reached under the EPAÂs National Petroleum Refinery Initiative (Refinery Initiative) and is similar in all material respects to previous Refinery Initiative settlements, covering all four Âmarquee CAA issues addressed under the Refinery Initiative. This settlement is part of the Air Toxics National Enforcement Priority and the Flare Efficiency and Minimization Initiative (Flare Initiative) and includes injunctive relief targeted at reducing emissions of volatile organic compounds (VOCs) and hazardous air pollutants (HAPs) from the two flares located at the refinery. In addition, CountyMark will pay a civil penalty to the United States of $167,000, and will spend $70,000 on diesel retrofits as a federal Supplemental Environmental Project (SEP). Further, CountryMark spent $111,666 on a state SEP in Posey County, Indiana.
