This is an Administrative Penalty action pursuant to EPCRA Section 313 issued to K-Tube Corporation. The violation involves failure to file timely Toxic Chemical Release Inventory Reporting Forms required under EPCRA Section 313 for chromium compounds, nickel compounds and trichloroethylene in the years 2003 through 2005. The Respondent self-disclosed these omissions on 08/09/06. Pursuant to the EPA Audit Policy, Respondent met the criteria for 75% mitigation of the penalty (calculated as $252,400). Accordingly, the Consent Agreement and Final Order established a penalty of $63,100.
