SCAFO-September 24, 2007, EPA commenced and settled an action under Section 113 of the CAA with the signing of a combined Consent Agreement and accompanying Final Order with BarberÂs Chemicals, Inc. (ÂBarberÂsÂ), a Pennsylvania corporation with an industrial supply distribution center located at 950 Main Street in Sharpsville, Pennsylvania. The facility receives cylinders of chlorine, among other chemicals, which it stores on its premises prior to shipment to public and private waster and wastewater treatment facilities. BarberÂs violated Section 112(r)(7) of the CAA, by failing to submit a Risk Management Plan, as required for its storage of chlorine in amounts in excess of 2,500 pounds. In settlement of this matter, BarberÂs has agreed to pay EPA a penalty of $50,064.96.
