ECCA CALCIUM PRODUCTS, INC.

On September 13, 2007, EPA, Region III filed a Consent Agreement and Final Order (“CAFO”) settling an Clean Air Act (“CAA”) administrative enforcement matter against E.C.C.A. Calcium Products, Inc., 10000 Beaver Dam Road, Cockeysville, MD 21030. The CAFO resolves violations of: 1) New Source Performance Standard (“NSPS”) regulations set forth at 40 C.F.R. Part 60, Subpart OOO, entitled “Standards of Performance for Nonmetallic Mineral Processing Plants” and 2) certain provisions of a federally-enforceable operating permit issued pursuant to the State of Maryland’s State Implementation Plan which was approved by EPA. Respondent agreed to a civil penalty in the amount of sixty-three thousand eight hundred dollars ($63,800) and certified to EPA that Respondent is presently in compliance with the provisions of the CAA, and the regulations promulgated thereunder that are referenced in this Consent Agreement, and that all violations alleged in the Consent Agreement have been remedied.
