This consent decree involved a settlement to perform a Remedial Design/Remedial Action and reimburse EPA for its past response costs at the Nepera Site. The consent decree was lodged with the United States District Court on June 27, 2008 and entered into Judgment on October 3, 2008. The consent decree requires the Settling Defendants to implement the remedy selected by EPA's September 28, 2007 Record of Decision through the mitigation of soil and groundwater pollution by constructing a biocell to treat contaminated soils and by remediating contaminated groundwater through the use of oxygenating compounds. The consent decree also requires the Settling Defendants reimburse EPA for past response costs and pay all of EPA's future oversight costs.
