Defendant filed a complaint in District Court asking the Court to set aside the EAB's Final Decision. In response EPA must file an Answer, asking the court to uphold the EAB's decision and order Defendant to pay the penalty assessed by the EAB, as well as comply with the regulations it was deemed to have violated. These requests are counterclaims which are akin to a new enforcement action.
