Perdue Farms, Inc. violated the CWA, section 301 because they exceeded their permit limits, failed to maintain the required one foot of freeboard on its lagoon and fialed tot ake samples as frequently as required. Perdue, respondent, also failed to obtain representative samples of the effluent it discharged to Parker Creek through outfall 001 and failed to perform proper function & monitoring. The complaint proposed a penalty of $137,500.
