Melvin Joseph Construction cleared and graded a stream channel in Georgetown, Sussex County, Delaware. The activity spanned approximately 1,500 linear feet of stream as well as adjacent wetlands. The entire site was forested before the disturbance, and the planned use for the site is claimed to be agricultural. An Administrative Order was issued on December 30, 2002 that requires the stream channel and adjacent wetlands to be restored. A penalty could be issued at a later date, if deemed appropriate. Any farming activities in uplands will not be affected by CWA 404 regulations
