Respondent had an upset condition due to a significant rainfall in Sept. 2002, resulting in a discharge with some effluent violations. Facility is a coal company and normally they have no discharge. Respondent also failed to submit a construction schedule report on time and it was about 8 months late. EPA is ordering facility to make changes to assure any future discharges meet the effluent limits and that Respondent turns in environmental reports on time.
