Summary

NOD issued 6/19/2003. Respondent failed to notify the SERC within 60 days after sulfuric acid, an Extremely Hazardous Substance, was present in excess of the threshold planning quantity. In violation of EPCRA section 302. Respondent failed to notify the LEPC of a designated facility representative who will participate in the emergency planning process as a facility emergency response coordinator. In violation of EPCRA section 303. Respondent failed to submit Material Safety Data Sheets (MSDS) for sulfuric acid to the SERC, the LEPC, and the fire department with jurisdiction over the facility within three months after being required to prepare or have available a MSDS for sulfuric acid under the Occupational Safety and Health Act. In violation of EPCRA section 311. Respondent failed to timely submit a Tier II report for sulfuric acid for the year 2001, and prior years, to the SERC, the LEPC, and the local fire departmet with jurisdiction over the facility. In violation of EPCRA section 312.
