NOD issued 6/19/2003. Respondent failed to include several hazardous chemicals on Tier II reports submitted to the State Emergency Response Commission (SERC), the Local Emergency Planning Committee (LEPC) and the fire department with jurisdiction over the facility for calendar years 1997 through 2001, as required by section 312 of EPCRA. On April 11, 2003, Respondent submitted its Tier II reports to the appropriate agencies.
