On XXX, I, [XXX], a person with quadriplegia who uses a wheelchair for mobility, was being transported by a Metro Mobility paratransit vehicle. During the process of exiting the vehicle as the lift platform was completing its unfold sequence and boarding the lift’s platform, the lift malfunctioned. The inner roll stop, which was in the horizontal bridging position to allow the passenger to cross from the vehicle floor to the lift platform, rotated upward unexpectedly while my wheelchair was partially positioned on it. This upward rotation flipped my wheelchair backwards, ejecting me from the platform and resulting in catastrophic cervical injuries including traumatic spinal impact. I retained a lawyer but after four years of no progress or answers on my case I fired my attorney after conducting my own research and investigation, hired an expert, and determined the cause. The defendants are working relentlessly to dismiss my case because their defense that I "prematurely boarded" causing the accident has no veracity because they can't replicate the mechanical sequence that would cause the malfunction.
